Tops Never Stops Stealing the Broadway Market Logo

The Broadway Market @ Tops…

While watching the news tonight on WIVB, I saw the Broadway Market logo in a story…a story shot partly at Tops.

I understand that some of the Market vendors sell their products at other places around WNY, but that doesn’t mean Tops can use the Market logo with their in store presentation.

My guess is that Tops wouldn’t be all to pleased if the Market used the Tops’ logo in their advertising or presentation. In essence, they are competitors. My guess is they don’t have permission to use it either.

Tops is telling people by ripping off the Market logo that there is no need to head down to 999 Broadway. This hurts the Broadway Market and its brand.

  1. It seems that the market, if it can prove damages, has a viable case.

    Even if no damages, I would suspect, that Tops has appropriated for itself something that is not Tops’ property and uses without regard to copyright.

    It is a sterling example of how big business not only injures the mom & pop businesses in theory and practice but highlights a specific practice – the use of a copyrighted and thus protected logo to influence customers to make purchases at their site rather than the Broadway Market.
